&#60;p&#62;Do you think it is possible for the passage of HR 2267 to allow for an intrastate sports betting site in the state of Nevada (note: I understand no other states (maybe DE) would have any chance at it as I know the Wire Act of 1961 covers this for the other 48 or 49 states)?&#60;/p&#62;
&#60;p&#62;Here is a post I made over in the poker section of 2+2, but didn&#38;#39;t really get an answer:&#60;/p&#62;
&#60;p&#62;“It will be very interesting to see how things shake out and what companies emerge as the US industry leaders for online poker. I really think that Nevada will be an interesting state to watch as they have always been the nations&#38;#39; leaders when it comes to most forms of gambling.  I think it is germane as it would seem that HR 2267 might be considered a green light to start things with intrastate gambling:&#60;/p&#62;
&#60;p&#62;Here in Nevada there are a couple of small things regarding sports betting that people are unaware of. First off, the Stations Casino Corp. has online sports betting offered to Nevada residents. I believe the daily total that can be wagered in $1000 or less. You have to set up the account in a Stations casino and fund it there as well. Also of note, Leroy&#38;#39;s (a sports book that subleases space in various casinos statewide and advertises itself as the largest sports book in Nevada) accepts bets over phone lines. There is some sort of pager or something that the bet has to come from and only works in some radius from the center of Las Vegas that covers Clark County I believe.&#60;/p&#62;
&#60;p&#62;Anyway, I think this may give states where sports gambling is legal (i.e. for sure Nevada and maybe Delaware) the ability to set up much larger operations in the examples I gave. The question will be would this put into jeopardy their ability to get a national license at some point because they are associated with online sports gambling. For instance, I don&#38;#39;t think that MGM or Caesar&#38;#39;s (Harrah&#38;#39;s soon to be new operating name) who would stand to be the biggest poker licensees might not risk having an online sports betting intrastate site for Nevadans only. But there will be a market for a lesser name like Leroy&#38;#39;s to try and do that since they would probably estimate that their share of the poker market would be very low and it would be more profitable to offer an online sports betting site for Nevadans.&#60;/p&#62;
&#60;p&#62;Are there any other Nevada residents or legal experts that have any opinions as to how they think all of this will shake out specifically in the one state that has always been most friendly to gamblers (with regard to B&#38;amp;M casinos anyway). &#60;/p&#62;
&#60;p&#62;My guess is that the top 5 US poker sites 5 years from now will all be major casino names MGM-Mirage, Caesar&#38;#39;s (Harrah&#38;#39;s), Wynn, Foxwoods, Seminole Hard Rock, etc…&#60;/p&#62;
&#60;p&#62;Does anyone think casinos with lesser names like South Point, M, Stations Casinos, Coast Casinos might opt to go for an intrastate online sports betting system?”&#60;/p&#62;
&#60;p&#62;The PPA has done wonders for poker players. It is a shame that sports gamblers could not create a group that does the same for it members. However, sports gambling has been vilified in American society for almost a century and that is not about to change any time soon that I can see.  This is especially true given the power of the professional sports leagues like the NFL, NBA, and MLB.  &#60;/p&#62;
&#60;p&#62;The hope is for me as a Nevada resident to have access to online sports lines from Nevada casinos some day as well as be able to play poker online.  In case no one is familiar here are a couple of links that I do think show a glimmer of hope for at least some expansion of online sports gambling intrastate wise in Nevada:&#60;/p&#62;

I am filing chapter 7 bankruptcy in kansas. I have played poker online a lot and lost a net roughly $2000 in the last two years. At one point I won $5,000 which I put most of back in my checking account. My debt and reason for filing bankruptcy is non-gambling related (over $100k). On a side note I have not reported any poker winnings on any taxes. Will this be a problem?&#60;br /&#62;
*Should I be listing any poker winnings/deposits over the last 2 years, in my bankruptcy?&#60;br /&#62;
*Should I be listing the money lost playing poker under &#38;quot;Losses&#38;quot; in the Statement of Financial Affiars or anywhere else?&#60;br /&#62;
*Will I get in trouble if I dont mention some of these items in my bankruptcy?&#60;br /&#62;
*Will I get in trouble for playing poker online at all in Kansas? &#60;/p&#62;
&#60;p&#62;I have played for recreation and entertainment on somewhat legitimate sites PS and FT..&#60;br /&#62;
both use third parties in order to pay you by check or bank eft, so all of these small charges to my checking account are to oddly named entities. Will the trustee and judge look at my bank statements and question each one or trace it?&#60;br /&#62;
My hunch is to just be honest and list it alll or play dumb if they mention it after not listing, but not if poker is illegal or will play agianst my case that might be very bad. Please let me know if you can answer any of these questions for it would be invaluable. I had an attorney but he did not know about this or a few other issues so I am filing pro-se.&#60;br /&#62;

<description>&#60;p&#62;While I in fact play at neither site, it is probably not the poker site that blocks you from using your NetSpend Visa card, but the NetSpend company that is refusing to do business with the poker site.&#60;/p&#62;
&#60;p&#62;A variation of this might be a breakdown in communications with the verification between the site and the card when you try to use it.  The NetSpend Visa authentication requires that match your card number, expiration date, probably your CVC, your first and last name, and your zip code.  &#60;/p&#62;
&#60;p&#62;If NetSpend does not have your name and zip code in their database, then it will not verify.  With most gift cards you enable this by logging on to their web site with your credit card number and telling them who you are.

<description>&#60;p&#62;An alternate way to access &#38;quot;European&#38;quot; poker site would be through a proxy that is based in Europe.  Both technical measures avoid using a US based IP address.&#60;/p&#62;
&#60;p&#62;Whether this is illegal or not depends on state law.  There are about 13 states that lean towards making online poker illegal.&#60;/p&#62;
&#60;p&#62;The concern you might have had is whether or not you are &#38;quot;kosher&#38;quot; with the UIGEA.  As it turns out the UIGEA does not make anything illegal for the poker player at all.  The UIGEA triggered many European sites to close access from US based IP addresses.  &#60;/p&#62;
&#60;p&#62;What you are proposing will bypass the restriction the poker site might place on you.

<description>&#60;p&#62;I’ve been responding piecemeal to concerns emailed to me about my anti-Ken Buck stance and other issues about the State PPA. Let me be specific to you all and make this discussion public. Here are some of the questions:&#60;br /&#62;
Q. Why are you so opposed to Ken Buck, what has he done to earn your animosity?&#60;br /&#62;
A. As a prosecutor in Weld County, Ken Buck made the determination to prosecute several PPA members for participating in a $10 buy in poker tournament held in a local bar. He has routinely ignored or passed off to underlings the prosecution of felony crimes while he concentrates on persecuting nickel and dime infractions that deal with interpretations of law wherein logical people might disagree on that interpretation. He is all about headlines and not about doing the job he was elected to. (Personal opinion)&#60;br /&#62;
Q. Why hasn’t the State PPA done more to bring the questions of poker’s legality to the fore front? Why haven’t you sued the State to get a determination of the legality of poker if it is truly a game of skill as you maintain? (Many similar questions along this vein)&#60;br /&#62;
A. Money. The Colorado PPA has existed mostly on the contributions of it’s principal officers and a few devoted participants. The only ‘significant’ donation to our coffers has come from the Denver Poker Tour and that was about a year ago. (Thanks again to Brian Masters and the DPT) We are broke. Litigation takes money, money we simply don’t have. We have even had to turn down offers of pro-bono services from lawyers because we can’t fund the paperwork. As a side note, the recent push by the National office to secure donations on July 1st was somewhat successful, however if I gave you the numbers from Colorado we would all be embarrassed.&#60;br /&#62;
Q. You’ve spoken of potential laws relaxing the State stance that poker is gambling. Any news on that front?&#60;br /&#62;
A. We routinely lobby State Representative and Senators to bring forward a provision that simply groups Poker in with other games recognized as games of skill. Once again, we are considered political lightweights in that we can’t fund our efforts. Lobbying takes money. In States where such efforts were successful, the money came from concerned poker players. We don’t seem to have very many of those in Colorado.&#60;br /&#62;
Q. What can I do to help?&#60;br /&#62;
A. If I haven’t made it clear what needs to be done then I simply lack the skills to do so. You figure it out.&#60;br /&#62;
In conclusion I would like to point out that no one, group or idea ever found the light of day without effort from those affected. If you are happy with the way things are, do nothing. If you are not, act. Don’t email me about what we are doing in the State PPA. Do something about it. &#60;p&#62;Looks like the new and updated rules for Michigan Charitable gaming moves all of us that are dealers into being employees of the House .. yet still restricts us to the same income limitations as those of the charity employees .. and still requires that the charities pay us, rather than our employer.  &#60;/p&#62;

&#60;p&#62;Could be a good place to play but is a little noisy and out of control at times. Shouting by management while dealing Black Jack is disruptive of the poker tables right next to it. Management shouts all the time instead of going around an announcing blind changes etc. Management loves to play loud rock music that makes it impossible to hear the other end of the table. Of course this causes the whole room to shout. Gives you a headache. With the Poker Zone going downhill, some of the players there are now coming here. Same problems that kill the Zone is now at the Lanes: soft play, collusion, talking about hands after out and play still going on, foreign language at table, cell phone use and foul language. It seems the management is not concern about the problems and is raking in the take. I predict this room will look like the Zone in a year. Grand Rapids and Muskegon have some good rooms so you do not have to put up with the problems. &#60;/p&#62;

&#60;p&#62;Since this room is almost equal distance for me to other rooms, I have given them another go. &#60;/p&#62;
&#60;p&#62;I am even more disappointed with the goings on. Dealers are allowed to play on their days off in the room. These are the some of the same dealer who look at players muck cards to get an idea of how different players play. This is very helpful information that the management sort of turns a blind eye on. I would like the State to do like the casinos and prohibit dealer play on site. &#60;/p&#62;
&#60;p&#62;Another problem is the soft play when a couple of dealers or more are at the same table. Check downs are common when they are heads up and chops are normal. &#60;/p&#62;
&#60;p&#62;A bigger problem is the pay offs. There is no set schedule for pay offs and the same dealers playing are sometimes the floor and make up the pay offs. One tournament had over 60 players with 7 places being paid. The problem is that the top 3 got almost 90% of the pay off. The bottom did not even make expenses. So much for the good player beating out 60 other players and being rewarded. This is not even close to casino structure pay offs, but gives a smoke and mirror illusion of big tournaments. But ones has to ask if the pay offs are slanted when the dealers are on the final table and their friends are making payoffs. This is especially true in the smaller tournaments.&#60;/p&#62;
&#60;p&#62;This could be a good place to play with some changes. I also would like to see the State make some changes so the playing field would not be slanted or distorted. They could start with a posted pay off schedule. &#60;/p&#62;
&#60;p&#62;The game of Poker should be fair and equal for all. Deal them up and be fore warned.

&#60;p&#62;If they want to keep your business, I would expect them to be as helpful as they can in assisting you to overcome this issue.  They may not HAVE an answer, but then again they might, so no harm in at least asking, right?&#60;/p&#62;
&#60;p&#62;At the least, they should be willing to let you stand up on a chair before play begins (or whenever all or most of the players are there) and give a &#38;quot;welcome to nameofbarhere&#38;quot; speech during which you can point out that the bar pays about $6 for each of them to come and enjoy the games, so you&#38;#39;d appreciate the players consideration by purchasing some food and drinks while they are there &#60;em&#62;if they want the games to continue to be available&#60;/em&#62;.&#60;/p&#62;
&#60;p&#62;Yeah you are still going to get the freeloaders, and I agree with the above that you can and should eject anyone who you would consider a nuisance at any non-poker time (in other words, whether or not poker is being played should not be an element of the decision to reprimand or eject) - but you also may well &#38;quot;wake up&#38;quot; some non-freeloaders who hadn&#38;#39;t realized the bar was incurring an expense for the games to be there.

<description>&#60;p&#62;A quick fix to the problem would seem to be to tell everyone to make a minimum purchase or to impose a charge for people coming in to play.  But how does this impact the legality of bar poker?&#60;/p&#62;
&#60;p&#62;Bar poker consists of freerolls for which there can legally be no cost to play.  There are three parts to gambling - valuable consideration, chance, and reward.  &#60;/p&#62;
&#60;p&#62;The PPA&#38;#39;s main strategy is to say that poker does not involve chance as it is a game of skill.  In contrast, bar poker is based on the concept that there is no consideration paid - it is free to play.  Add consideration to the mix and you have full fledged gambling, which is probably illegal in most bars.&#60;/p&#62;
&#60;p&#62;Generally it is accepted that a cover charge or a minimum purchase is sufficient to make bar poker illegal.&#60;/p&#62;
&#60;p&#62;A strategy that some bars employ is to charge people money anyway.  Another more interesting strategy I have heard is for the management to eject non paying players based on loitering.  I don&#38;#39;t know how it effects the bottom line, but ejecting non paying players seems to give some bar owners a sense of satisfaction.&#60;/p&#62;
&#60;p&#62;My advice, if you were to ask, would be to ignore the people who don&#38;#39;t spend money and concentrate on the people who do spend money.  Offer people something they wish to pay for, build a sense of community, and let them know it is free to them, but not free to you.  They need to act like adults and spend money or lose their venue.&#60;/p&#62;
&#60;p&#62;You mention that you had a good group of spenders who were run off by people who did not spend money.  You suggested they were troublemakers of some sort.  Maybe it was their lack of hygiene.  Maybe they &#38;quot;did not play right&#38;quot;.  But whatever it was you are suggesting they did not adhere to community standards and the community left.  &#60;/p&#62;
&#60;p&#62;Just tell you troublemakers to clean up their act, or leave and not come back.  If you would not tolerate another customer ruining your business, why do you tolerate the special poker players?&#60;/p&#62;
&#60;p&#62;Define why these people are a problem for you.  Define what do they do that is &#38;quot;bad,&#38;quot; but stay away from the idea that they don&#38;#39;t spend money.  Then warn them and then eject them for not following the rules.  What do these players do to annoy that runs off your &#38;quot;good&#38;quot; players?&#60;/p&#62;
&#60;p&#62;You should generally be able to refuse service to anyone who does not act within the boundaries of your community standards.
