We at PPA wish everyone in the poker community a healthy and happy holiday season. Thank you all for your continued support!

With poker legislation pending in the House and with the poker issue continuing to gain momentum nationwide, it is clear that 2012 will be a year of great opportunity for us. It will also be a year of challenges. That is why it is important for all of us to participate in this fight. I ask that everyone keep active in 2012 to ensure that we are heard on Capitol Hill. We can win this if we all take a stand for our rights!

To win this fight, it is vitally important for all of us to remain unified and to speak with one voice, one goal, and one mission. This is one reason PPA has been so vigilant in reaching out to the poker community with what I believe to be the most open communication of any group of our size. We need the poker community to understand what PPA is doing and why, and we need to ensure that we hear and act on the concerns of the poker community. After all, PPA is not a “they”. It is our shared fight as poker players and enthusiasts. You can expect PPA to keep this up in 2012 and beyond.

I look forward to the New Year and to the poker community continuing to make itself heard on Capitol Hill and across the country!

Commentary

Speaking of unity, I. Nelson Rose, a law professor with expertise on gaming law, has chosen to attack online poker supporter Rep. Joe Barton (R-TX). These attacks were made on CalvinAyre.com on October 21st (listen here), on OnTilt Radio on December 5th, and in a recent column in Poker Player Newspaper (here). The attacks center not on issues of the legislation itself, or even of poker-related issues. Rather, they focus on Rep. Barton’s politics and on Rose’s apparent disagreement with them. This is unfortunate and, in my opinion, very misguided. It is sad that Rose chose to insert his personal politics into our fight.

A key component of PPA’s legislative strategy has been to earn the support of lawmakers from both sides of the aisle. The Unlawful Internet Gambling Enforcement Act passed the House in 2006 as HR 4411, a freestanding bill at the time, by a margin of 317-93. It had the support of majorities of House Democrats and Republicans alike. As we have opponents on both sides of the aisle, it is clear that we need bipartisan support for our fight. Additionally, as many elected representatives from that era remain in Congress, it is equally clear that victory requires past “nays” to become “yays”. The poker community celebrates when this occurs. I know I do, and I know you all do as well!

Rep. Barton believes in our right to play. He was especially well-spoken and passionate in defense of our game at the hearing on online poker held by the House Subcommittee on Commerce, Manufacturing, and Trade on October 25th. He is a great champion for the cause and has earned the support of the poker community.

I believe Professor Rose should keep his attacks on Rep. Barton separate from activities where he is claiming to speak for the poker community. He ought not bring his personal politics into our fight.

Weekly Update from Rich Muny, VP of Player Relations

Poker has had a terrific couple of months. The online poker hearings in the House and the Senate were clear victories. Additionally, most Las Vegas brick and mortar casinos, and the American Gaming Association, have come out in favor of licensing online poker in the U.S. We are truly making headway on the Hill!

Unfortunately, Las Vegas Sands’ CEO Sheldon Adelson has recently come out against online poker legislation, citing concern over the age verification technology. “He does have young children, in their early teens, and he has raised this concern before,” said PPA Executive Director John Pappas. “I think he does have some concerns there, but I think he’s somewhat misinformed. There are ways being used very effectively throughout Europe, where this is licensed and regulated, to keep children off Internet gaming sites.”

Fortunately, we poker enthusiasts did not give up. Instead, we rose up and told Congress that we demand our rights, showing them that millions of us are behind this!

Washington Update

Last week, just before the Thanksgiving holiday, it was formally announced that the Joint Select Committee on Deficit Reduction failed in its objective to deliver to Congress a comprehensive package to reduce our nation’s ballooning national debt. When the Committee was announced this summer, the PPA jumped on the opportunity to present Internet poker as a new revenue stream for the Committee to consider. Our team of lobbyists met with every member of the “super committee” to explain the sound public policy reasons for including a regulatory bill like H.R. 2366 in the final product. But more importantly, our membership was full throat in letting the Committee know that Internet poker should be part of the package.  

Whether it was through Facebook, Twitter or directly through the committee’s contact email, PPA members were the # 1 advocates. Time and time again we heard directly from Members of Congress and their staffs that poker players were the most vocal of any interest group and because of this activism we were given serious consideration during the process. Unfortunately, political stalemate, an all too familiar position for this Congress, prevented a deficit solution and thusly excluded the opportunity for Internet poker legislation from being part of a debt committee deal. To be clear, even if the Committee did produce a product it would have been a difficult to get poker included, but we definitely made an impact and have elevated the issue for future consideration. Congress still has work to do this year and that means we do too. The PPA and our team is seeking every opportunity to get our legislative priority passed into law. We remain optimistic that other legislative vehicles will be available before the end of this year. In the meantime we continue to pursue hearings to discuss H.R. 2366 and we are pushing for a vote very soon in the House Energy and Commerce Committee.

Barney Frank to Retire

Yesterday, Congressman Barney Frank (D-MA) announced that he will not seek re-election and will leave Congress at the end of his term in 2012. The poker community is losing a true friend in Congressman Frank. In 2007, one year after the passage of the Unlawful Internet Gambling Enforcement Act (UIGEA), Mr. Frank, then Chairman of the House Financial Services Committee led the charge to repeal the law and replace it with a licensed and regulated environment to play poker and other games on the Internet. Despite constant opposition, Barney Frank persisted and eventually passed his bill out of his committee with strong bi-partisan support. And his advocacy for our rights still continues. Just two weeks ago he spoke passionately before the House Energy and Commerce Committee about his legislation to give adults the freedom to gamble and play poker on the Internet.


Congressman Frank was admittedly not a poker player. But he valued the idea that adult Americans should be able to play poker over the Internet in their own home, over their own Internet connection with their own money. He was aghast that government was impeding on this freedom. Barney Frank is outspoken, incredibly smart and most definitely a controversial politician. However, you may feel about his overall policy beliefs there is no doubt that he has been poker player’s greatest champion in the Congress. And because of his leadership we now have dozens of Congressional champions from all sides of the political spectrum. We urge you to take a moment to thank Congressman Barney Frank for being an advocate for your rights. I received much feedback from the community regarding our two excellent appearances on Capitol Hill earlier this month. Many see the tide continuing to turn in our favor. I see this as well and am gratified that the community has optimism. While this continues to be a tough fight, I am glad we are all taking a moment to savor our hard-won victories.

Let’s all continue to build on this momentum. I encourage everyone to take a few moments to do your part to let our elected representatives know where we stand. Many anti-gaming types claim the American people wish to ban poker and that ALL gaming legislation is driven solely by industry lobbyists. Here’s a statement from the Congressional website of Rep. Frank Wolf (R-VA), who testified against our right to play at the November 18th House subcommittee hearing, which illustrates this position perfectly:

“The political process also can be tainted. In state after state, the gambling industry bankrolls local politicians from both parties in hopes of advancing its interests, leaving opponents out-financed, out-gunned and out-manned. The fact that gambling has not spread further is a tribute to the tireless efforts of a few grassroots activists. These citizens advocacy efforts — often outspent by rates of 20 to 1 — have held the levy against even further encroachment by the gambling industry into every community in America.”
Grassroots poker advocacy efforts directly counter this incorrect mindset by demonstrating that there are millions of real people behind the pro-poker effort. Our efforts also serve to provide objective evidence to lawmakers that there are not hordes of anti-gaming Americans waiting to pounce on anyone who supports the right to play poker. Lawmakers check their Twitter feeds, Facebook walls, and email inboxes and see not only a lot of pro-poker activity, but little to no anti-poker activity in response. In many cases, this runs directly contrary to the expectations of many elected representatives.

So, please be sure to sign YOUR NAME to this effort by telling your lawmakers to support your rights. Let’s ensure that they know this liberty is being sought by millions of Americans, including you!

Member Questions

I regularly communicate directly with players on several online forums under my online handle “TheEngineer” and via phone and email. Since taking this role on June 1st, I have received almost five hundred emails and have responded to all of them. I received several phone calls and IMs as well. Here are a few responses that I thought would be of interest to the community:

Stop bragging about where you’re appearing and yadda yadda yadda….. get my money back from Full Tilt Poker!!!

My appearances on webcasts are not something about which I would ever brag. Even my wife says I am a better writer than a speaker :-) . I go on these shows, and now host a show of my own, solely because I believe it to be very important for PPA to have the best possible communication with the poker community. After all, we’re a “we”, not a “they”. This is our shared fight for our rights.

As for Full Tilt, I wish you the best in recovery. I have around five figures locked up myself. PPA is doing all it can on the FTP situation (and AP and UB as well). We have met with the Justice Department to assert that the frozen funds belong to players. We are all hopeful that the DOJ permits the proposed purchase by Groupe Bernard Tapie, of course, as that is likely our best chance at getting 100% reimbursement.

That being said, PPA is neither a regulatory body nor an enforcement agency. We are a player advocacy group, so our ability to force these sites to comply with our calls for action is limited. In fact, this is why PPA is pushing for legislation that gives us the rights we need as players. The PPA-supported legislation now in Congress focuses strongly on consumer protection. It mandates protected and segregated player accounts, a U.S. presence (to allow for law enforcement action if needed), and many other provisions that protect our rights as players.

I encourage everyone to do all we can to support this important legislation.

What gives Congress the authority to limit online poker?

The federal government derives its authority here via the Constitution. The right to regulate interstate and foreign commerce is an enumerated power of the Congress, per Article I, Section 8, Clause 3 of the U.S. Constitution (“[The Congress shall have Power] To regulate Commerce with foreign Nations, and among the several States, and with the Indian tribes”).

I certainly agree that it is absurd for the federal government to tell us what we can do in our own homes on our own computers. We will keep telling Congress that we demand our liberties on this matter. Fortunately, we also have an important right under the Constitution – the right to petition the government for redress of grievances (part of the First Amendment). I am glad that we are all doing just that. I thank you for standing strong with us in this fight!

I have great news for everyone. PPA had two excellent appearances on Capitol Hill last week!

The Senate Indian Affairs Committee held a hearing to examine the potential impact of Internet gaming regulation on Indian tribal interests on Thursday, November 17th. PPA Chairman former Sen. D’Amato testified for PPA, accompanied by PPA Executive Director John Pappas.

I have great news to share with everyone. There will be TWO hearings on the online poker issue this week!

The Senate Indian Affairs Committee is holding a hearing to examine the impact of Internet gaming regulation on Indian tribes on Thursday, November 17th at 2:15 PM ET. PPA Chairman former Sen. D’Amato will testify for PPA, to be accompanied by Executive Director John Pappas.

The Senate committee hearing is excellent news for the poker community, as this is not the type of hearing where the poker community would necessarily expect to be invited to provide testimony. The invitation was due both to Sen. D’Amato’s esteemed background and to the activism of all of us in the poker community. Getting a hearing scheduled prior to the Thanksgiving recess was an accomplishment as well. Additionally, the U.S. House Subcommittee for Commerce, Manufacturing, and Trade will hold another hearing on Internet gaming on Friday, November 18th at 9 AM ET. These hearings are hard evidence of the great work the poker community has been doing to ensure lawmakers hear from us. I thank everyone for taking the steps necessary to ensure our elected representatives understand that we poker enthusiasts will not back down and will not simply go away!

To ensure that your elected representatives know you demand your rights, please bookmark the daily action plan and check it out every day. I update it every morning with new actions we can take to stand up for the game. These take just a couple of minutes to complete. We have received excellent feedback from lawmakers and our lobbyists on the effectiveness of these actions.

Weekly Update from Rich Muny, VP of Player Relations

I always enjoy meeting with the poker community to discuss the issues on everyone’s mind. I think it is very important to meet with everyone, so I do it as often as I can. This week, I had the pleasure of going to the Breeders’ Cup Poker Tournament in greater Louisville (only an hour from my home) to meet with fellow poker players.

It was a great event. I was very happy to hear of the general enthusiasm for the fight for our rights. The community is genuinely enthused by the recent Congressional hearing on online poker/gaming issue and by the progress of HR 2366, the Online Poker Act.

I am proud that we are continuing to take this fight to our opponents. In the dark days of 2006, when the Unlawful Internet Gambling Enforcement Act passed, the forward momentum we have now seemed hard to imagine. It is gratifying that, while we may remain underdogs, there is a feeling that we have some wind at our backs. I thank all of you for that.

So, let’s keep this up! Please take a moment today to send your elected representatives snail mail letters telling them we wish for them to support our right to play. It will take just a couple of minutes! Again, thank you all for taking the time to stand up for our right to play.

Thank you all for taking the time to stand up for our right to play. As you know, this paid off for us big time last week, as we were heard by the House Subcommittee for Commerce, Manufacturing, and Trade. This hearing was a direct result of the advocacy of the poker community. You can watch the full 2½ hour committee hearing and read articles about the hearing here.  

I was impressed with PPA Chairman D’Amato’s testimony. I was also impressed with the impassioned support of Congressman Joe Barton (R-TX), sponsor of HR 2366, the Online Poker Act. His strong pro-poker statements really demonstrated the impact of our efforts in educating Capitol Hill on the support the game of poker enjoys across the nation.

Some members have shared with me their reluctance to join social networks due to privacy concerns. Fortunately, we can sign up for YouTube, Twitter, and Facebook with pseudonyms if we wish not to divulge personal information.

The poker community has been very effective on social media, so it makes sense for us to utilize this community core competency. These are very beneficial activities for us because they provide objective evidence to lawmakers of support and passion for our position, while simultaneously showing a lack of active opposition. In other words, these efforts really do make a difference.

Recap of Today’s Important Congressional Gaming Hearing & Other Highlights

Recap of Today’s Important Congressional Hearing & other Highlights As you know, the House Subcommittee for Commerce, Manufacturing, and Trade held a hearing today examining the potential regulation of Internet gambling.  The hearing entitled, “Internet Gambling: Is There a Safe Bet?” called upon a variety of witnesses to discuss how best Internet gambling can be regulated in the U.S.  Among the witnesses was Poker Player Alliance Chairman and former Senator, Alfonse D’Amato.  A complete list of witnesses and their full testimonies is available here. Senator D’Amato did an exceptional job and delivered impassioned remarks defending your right to play.  He urged Congress to adopt rules and regulations to ensure American consumers have a safe marketplace in which to play poker on the Internet.  In fact, when it came to consumer protections the conclusion of every witness before the Committee was that regulation was far better than the status quo.  And, more importantly, that sentiment was also expressed almost unanimously by the lawmakers who attended the hearing.  The question on the lawmakers’ minds was not “if” internet poker should be regulated, but rather “how” should regulation look.  

We have come a long, long way from just a few short years ago when Congress could only talk about how best to prohibit Internet gambling and poker.  This shift in attitude has much to do with the advocacy efforts of your PPA and the poker community in general who have done so much to educate lawmakers on this issue.  We have turned opponents into champions for our cause and completely changed the debate in Washington D.C.  

As I stood with Senator D’Amato today meeting with members of the Committee — before and after the hearing — I was immensely proud to hear every lawmaker tell us that they are being contacted by poker players in their districts.  While politicians often give us reason to be cynical about government, one thing is clear, they appreciate hearing from the voters on issues that matter most.  Please keep up the pressure and please continue to make your voice heard.  It is truly paying off!

We all have much to be proud of, but there is still much more to do.  I hope you will consider the next step in supporting the PPA by becoming a 2012 member today.  We are offering a special $15.00 deal (normally $20.00) that gives you a PPA membership for the remainder of 2011 and all of 2012!  This should be a “snap call” for any poker player who wants to continue the fight for our poker rights.

Other Highlights
  • The PPA would like to thank Congressman Joe Barton for his continued leadership on this issue.  He was excellent at today’s hearing and he is working to educate every member of Congress about the benefits of regulated Internet poker.  Check out his opening statement from today’s hearing.
  • This week the National District Attorney’s Association, the oldest and largest professional organization representing criminal prosecutors in the world, issued a statement in support of regulated Internet poker.
  • Check out a good opinion piece by former FBI Director Louis Freeh and former Homeland Security Secretary Tom Ridge highlighting the need for Internet poker regulation.
  • The Hill, one of the leading publications for Congress, has a good recap of today’s hearing.
